Terms of Service
Welcome to Kai. These terms describe what you can expect from us, what we expect from you, and the limits of what Kai is and isn’t. Please read them; using Kai means you accept them.
1. Who we are
Kai is a mobile app and service operated by Thymen van de Lagemaat, an independent developer based in the Netherlands (referred to as “we,” “us,” or “Kai” in these terms). Contact: support@kaicoach.app.
2. What Kai is (and isn’t)
Kai is an AI-assisted coaching tool for fitness and training. It uses large language models to generate suggestions, plans, and explanations grounded in the training data and personal context you provide.
Kai is not a medical professional, physical therapist, registered dietitian, or licensed coach. The information Kai generates is for general informational purposes and should not be taken as medical advice, diagnosis, or treatment. Always consult a qualified professional before making significant changes to your training, nutrition, or recovery, especially if you have an injury, medical condition, or are pregnant.
AI models can make mistakes. Kai may produce inaccurate, incomplete, or unsafe recommendations. Use your own judgment. If something Kai says doesn’t feel right for your body, don’t do it.
3. Your account
You need an account to use Kai. When you sign up, you agree to provide accurate information and to keep your login credentials secure. You’re responsible for all activity that happens under your account.
You must be at least 16 years old to use Kai. By creating an account, you confirm that you meet this requirement.
You can delete your account at any time from inside the app (Menu → Settings → Delete account) or by emailing privacy@kaicoach.app. See the account deletion page for details.
4. Free and Premium plans
Kai offers a free plan with a monthly message limit, and a Premium plan that unlocks higher limits and additional features such as Hevy API sync. Specific limits and features are described in the app and may change over time; we’ll notify you in advance of material reductions to what your current plan offers.
Subscriptions
Premium subscriptions are sold and billed through the Apple App Store (iOS) or Google Play (Android). Pricing, taxes, and currency are determined by your store account. Your subscription auto-renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
You manage your subscription in your store account, not directly with us. To cancel, change plans, or update payment details, visit your subscription settings in the App Store or Google Play app on your device. Deleting the Kai app does not cancel your subscription.
Free trials
We may offer a free trial period for Premium. If you don’t cancel before the trial ends, your subscription will start automatically and you’ll be charged. You can cancel at any time during the trial in your store account.
Refunds
Refund requests are handled by the App Store or Google Play, not by us. If you believe you’re entitled to a refund (for example, you were charged unexpectedly), submit a refund request directly to Apple or Google Play.
EU and UK consumers have a statutory right to withdraw from a digital services contract within 14 days of purchase. By starting to use the Premium service immediately after purchase, you consent to begin performance of the contract during the withdrawal period and acknowledge that you may lose this withdrawal right once the service has been substantially provided. Where the withdrawal right still applies, you can exercise it by contacting support@kaicoach.app.
5. Acceptable use
We trust you to use Kai in good faith. Specifically, you agree not to:
- Use Kai for anything illegal or harmful to others.
- Try to extract, copy, or resell Kai’s underlying models, prompts, or system behavior.
- Use Kai to generate content that violates anyone’s rights, privacy, or dignity.
- Attempt to reverse-engineer, scrape, or overwhelm our servers.
- Share your account with others or create accounts on someone else’s behalf without permission.
- Use Kai to give coaching advice to other people commercially without our written permission.
We reserve the right to suspend or terminate accounts that violate these rules, with notice where reasonable.
6. Content you provide
You keep all rights to the content you put into Kai (your training data, profile information, messages, and anything else you share). You grant us a limited license to process this content as needed to provide the service: store it, send it to AI providers to generate responses, display it back to you, and use it to improve the service for you.
We do not use your content to train AI models. See our Privacy Policy for details.
7. Content Kai generates
Kai’s replies are generated by AI in response to your inputs. Outputs may be similar across different users asking similar questions, and we make no exclusivity claim over them. You’re free to use Kai’s outputs as you see fit for your personal training, subject to the AI provider’s usage rules and the disclaimers in section 2 about medical advice.
Outputs may be inaccurate, incomplete, or inappropriate for your situation. You’re responsible for evaluating them critically and deciding whether to act on them.
8. Service availability
We aim to keep Kai available and reliable, but we don’t guarantee uninterrupted service. The service may be temporarily unavailable for maintenance, updates, or due to issues outside our control (such as outages at our hosting providers or AI service providers).
We may discontinue features, change how features work, or sunset the service. For material changes that affect paid users, we’ll provide reasonable notice and, where appropriate, a prorated refund.
9. Disclaimers and limitation of liability
Kai is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of Kai, including but not limited to loss of data, lost profits, training injuries, or decisions made based on Kai’s output. Our total aggregate liability for any claim arising out of or relating to these terms or Kai is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) €50.
Nothing in these terms limits liability that cannot be limited under applicable law: for example, liability for gross negligence, intentional misconduct, or statutory consumer rights.
10. Changes to these terms
We may update these terms as Kai evolves. The “Last updated” date at the top reflects the most recent revision. For material changes (anything affecting your rights or our obligations), we’ll notify you by email or in-app message at least 14 days before the change takes effect. If you don’t agree to the new terms, you can stop using Kai and delete your account before the change takes effect.
11. Governing law and disputes
These terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. If you’re a consumer, you also benefit from any mandatory protections of the law of the country where you live.
We’d much rather solve any problem directly. If you have a complaint, please email support@kaicoach.app first and give us a chance to make it right.
If we can’t resolve a dispute informally, it will be brought before the competent courts of the Netherlands. EU consumers may also use the European Commission’s Online Dispute Resolution platform.
12. Miscellaneous
- Severability. If any part of these terms is found unenforceable, the rest remains in effect.
- No waiver. If we don’t enforce a right, that doesn’t mean we’ve given it up.
- Assignment. You can’t transfer your account or rights under these terms to anyone else without our written permission. We may transfer our rights and obligations (for example, if Kai is sold or restructured) with notice.
- Entire agreement. These terms, together with our Privacy Policy, are the complete agreement between you and us about Kai.
